These Terms of Service ("Terms") govern your access to and use of the Blooming World International website at blwi.org, your account, our job application portal, and our anonymous whistleblowing/reporting service (together, the "Services"). Please read them carefully — they include limitations on our liability and a governing law clause.
By accessing or using the Services provided by Blooming World International ("BWI", "we", "us", or "our"), a non-profit organization headquartered in Nairobi, Kenya, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not access or use the Services.
These Terms apply to all visitors, registered users, job applicants, whistleblowers/reporters, donors, partners, and anyone else who accesses or uses the Services. We may modify these Terms at any time; material changes will be reflected by updating the "Last updated" date above, and, where reasonably practicable, communicated to registered users.
To register an account, you must be at least 18 years of age, or at least 13 with verifiable parental or guardian consent, and have the legal capacity to enter into a binding agreement. Our whistleblowing form does not require an account and may be used anonymously by anyone.
You may create an account directly, or sign in using a third-party identity provider (currently Google or LinkedIn). If you use a third-party provider, that provider's own terms and privacy practices also apply to your use of their sign-in service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account, and must notify us promptly of any unauthorized access at legal@blwi.org.
We may suspend or disable any account at our reasonable discretion, including where we believe these Terms have been violated, without prejudice to any legal rights you may have to challenge that decision.

When you apply for a role through our job application portal, you may submit personal details, a CV/resume, cover letter, and related documents. You confirm that the information you submit is accurate and that you have the right to share any documents you upload.
Submitting an application does not guarantee an interview, offer, or any form of engagement with BWI. We process applicant data as described in our Privacy Policy, including storage with our hosting and file-storage providers.
Our whistleblowing portal exists to let anyone — staff, partners, beneficiaries, or members of the public — report suspected misconduct, safety issues, harassment, financial impropriety, or other ethical or legal violations connected to BWI's operations.
You may submit a report anonymously or provide contact details voluntarily. Reports must be made in good faith and to the best of your knowledge; you should not use the portal to make claims you know to be false. BWI does not tolerate retaliation against anyone who reports a genuine concern in good faith, whether or not the concern is ultimately substantiated.
How report data is collected, restricted, and retained is described in the dedicated "Whistleblower Report Confidentiality" section of our Privacy Policy.
Our website may list and recognize donors, project funders, research partners, and community partners as part of our commitment to transparency. Inclusion on this list does not constitute an endorsement by either party except as separately agreed.
The Services do not currently process online donation payments. If BWI enables online giving in the future, that functionality will be governed by additional terms presented at the time, including the terms of our third-party payment processor.
The Services and their original content - including our research publications, curricula and training materials, photography and video, website text and design, and the BWI name and logo - are owned by Blooming World International or its licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you a right to use our name, logo, or branding without our prior written consent.
Because education is central to our mission, we allow limited, attributed, non-commercial reuse of certain published research and educational materials, and apply additional safeguards to media featuring program participants, including children. The specific terms of what may and may not be reused are set out in our Copyright Notice, which forms part of these Terms.

By submitting content, you grant BWI a limited, non-exclusive license to use, store, and process that content solely for the purpose for which it was submitted — such as evaluating a job application or investigating a report. The Services integrate with, or link to, third-party services including Google and LinkedIn (for sign-in), Cloudflare (spam protection), and BWI Academy (bwiacademy.com), as well as our social media channels. We are not responsible for the content, security, or privacy practices of these independently operated third-party services.
The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law.

To the fullest extent permitted by applicable law, BWI, its directors, employees, volunteers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your access to or use of, or inability to access or use, the Services. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
You agree to indemnify and hold BWI and its staff harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the Services or your breach of these Terms, except where such claims result from BWI's own negligence or wrongdoing.
We may suspend or terminate your access to the Services, with or without notice, if we reasonably believe you have violated these Terms, engaged in abusive use, or where required by law. You may stop using the Services and, where applicable, close your account at any time via account settings or by contacting us.
These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles, without depriving you of any mandatory consumer-protection rights you may have under the law of your own country of residence.
If any provision of these Terms is held invalid or unenforceable by a competent court, the remaining provisions will remain in full effect, and our failure to enforce a right is not a waiver of that right.
We may update these Terms from time to time to reflect changes to the Services or applicable law. Continued use of the Services after an update constitutes acceptance of the revised Terms.
